TERMS AND CONDITIONSThe Insured being the subscriber of SingTel by Registration and Declaration which is the basis of and is deemed to be incorporated within this contract has applied to MSIG Insurance (Singapore) Pte. Ltd. (the Insurer) for the Insurance contained herein and has agreed to pay the premium as consideration for such insurance. The Insurer agrees that if covered forms of accidental physical loss or damage to the Mobile Phone of an Insured occur during the Period of Insurance, the Insurer will make good to that Insured such loss or damage depending on the Plan selected, less the Excess applicable and subject always to all other terms, conditions and exceptions of this Policy. EXCEPTIONS CONTINGENCIES EXCLUDED This Policy does not insure (1) consequential losses of any description. (2) the cost of replacing defective or faulty materials, failure of design or fault, defect or omission in design plan or specification. (3) breakdown and/or mechanical malfunction of the Mobile Phone. (4) loss or damage to electrical parts, devices, fixtures or wiring caused by artificially generated electrical current. (5) loss or damage caused by or resulting from : (i) obsolescence, normal maintenance, gradual deterioration, wear, tear, rust, corrosion, slowly developing deformation or distortion of flaws; latent defect; change in temperature or humidity, moth, vermin, termites, other insects or inherent vice; failure or inadequate operation (or any variation in temperature) of any air conditioning, cooling or heating systems. (ii) action of light. (iii) exposure to weather and/or atmospheric conditions where the Mobile Phone is left in the open and not contained in fully enclosed buildings. (i) any fraudulent scheme, trick, device or false pretence practised upon the Insured, or upon any person(s) having care of the insured mobile phone at such time; (ii) infidelity or dishonesty on the part of the Insured, any family members or any of the employees of the Insured. (7) any loss of or damage to the Mobile Phone directly or indirectly caused by or resulting from (i) war, invasion, act of foreign enemy, warlike operations (whether war be declared or not), civil war, rebellion, revolution, insurrection, military or usurped power, confiscation, requisition or destruction of or damage to property by order of Government or Local Authority. (ii) nuclear weapons material or ionising radiations or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel. For the purpose of this Exception, combustion shall include any self sustaining process of nuclear fission. (iii) volcanic eruption, tidal wave, subsidence, landslip, erosion, settling or cracking in structures resulting from earth movements; shrinkage or expansion of foundations, walls, floors or ceilings. (iv) fumes or failure of the water, gas, electricity or fuel supplies to the Situation specified, but this Exception does not apply to fire or explosion caused by fumes or the failure of the water, gas, electricity or fuel supplies. (v) martial law or state of seige or any of the events or causes which determine the proclamation or maintenance of martial law or state of seige. (vi) any act of any person acting on behalf of or in connection with any organisation with activities directed towards the overthrow by force of any de jure or de facto Government or to the influencing of it by terrorism or violence or looting sacking or pillage in connection with any of the aforementioned occurences. (vii) strike or riot (8) Cost and expenses arising from loss or destruction or damage caused by pollution or contamination except destruction or damage to the Mobile Phone caused by pollution or contamination resulting from a peril insured against by this Policy. (9) Loss or damage due to mere unexplained disappearance, misplacement or when left unattended whether deliberately or inadvertently in public transport or any public place except in a securely locked vehicle. (10) Loss or damage arising from the wilful act or wilful negligence of the Insured or any family member or any employee of the Insured. (11) Scratching or denting of the Mobile Phone which does not compromise its performance. (12) Cost of adjustments or rectifications of operational malfunctions unless necessitated by loss or damage covered by this Policy. CLAIMS CONDITIONS 1. Where any loss or damage giving rise or likely to give rise to a claim under this Policy occurs the Insured shall immediately upon becoming aware of such loss or damage give immediate notice to the
(a) Police and take all practical steps to discover and punish the guilty person or persons and to trace and recover the lost or damaged Mobile Phone if the loss or damage arises from theft or any attempted theft.
(b) Insurer and within 14 days after that, deliver to the Insurer a claim in writing and supply all such details particulars and proofs as may be reasonably required by the Insurer.
2. If any claim be in any respect fraudulent or if any fraudulent means or devices be used by the Insured or anyone acting on behalf of the Insured to obtain benefit under this Policy all benefit under this policy shall be forfeited. 3a) Where a claim is made under this Policy the Insurer may at its option and subject to Clause 3(d): (i) have the Mobile Phone repaired as circumstances permit and in a reasonably sufficient manner or (ii) issue the Insured with a voucher that must be presented to the Policyholder who will exchange the voucher with a mobile phone of identical or reasonably similar make and type or (iii) pay the Insured in cash an amount equal to: · the cost of reasonable repairs or · the value of that Mobile Phone at the time of its loss · or the sum insured whichever is the least, less Excess 3b) Upon the happening of any loss or damage covered by this Policy, the sum insured in respect of the Mobile Phone shall immediately stand reduced by the amount paid or payable in respect of such damage. 3c) In any one Period of Insurance, only one claim can be made for the total loss of the Mobile Phone whether due to total physical destruction or any other cause covered by the Policy. In the event of a second claim, the Excess will be doubled and the Insured shall be considered as a coinsurer for 50% of the loss or damage after applying the Excess. 3d) In event of a claim payable under this Policy, the Insurer may require the Insured to pay up the balance of the annual premium due for the Period of Insurance first before the Insurer processes settlement of the claim or, where Insurer exercises its option to settle by way of payment, the Insurer can pay the assessed value of the claim less all of the annual premium yet unpaid and such payment shall constitute a full discharge of the claim. 4. If at time of the happening of any loss or damage covered by this Policy there shall be any other insurance covering the same loss or any part of it the Insurer shall not be liable for more than its rateable proportion thereof.
5. The Insured shall at the expense of the Insurer do and permit to be done all such acts and things as may be necessary or required by the Insurer for the purpose of enforcing any rights or remedies or of obtaining relief of indemnity from any party to which the Insurer shall be or would become entitled or subrogated upon the Insurer paying a claim under this Policy whether such acts and things shall be or become necessary or required before or after payment by the Insurer.
6. If any difference shall arise as to the amount to be paid under this Policy (liability 'being otherwise admitted) such difference shall be referred to an arbitrator to be appointed by the parties in accordance with the relevant statutory provisions for the time being in force. Where any difference is by this condition to be referred to arbitration the making of an award shall be a condition precedent to any right of action against the Insurer.
7. If a claim is made and rejected and an action or suit is not commenced within 6 months after such rejection or (in the case of an arbitration taking place as provided in Condition 6) within 6 months after the arbitrator makes his award, all benefits under this policy are forfeited.
8. The indemnity provided by this Policy shall not apply to nor include the first amount of each and every loss or damage described in the Schedule as Excess. 9. The due observance and fulfilment of the terms provisions and conditions of this Policy insofar as they relate to anything to be done or not to be done by the Insured and the truth of the statements and answers in the proposal shall be conditions precedent to any liability of the Insurer to make any payment under this Policy. GENERAL CONDITIONS1. Application of Terms This Policy is restricted to SingTel Subscribed Mobile Phones only, one SingTel line to one mobile phone. The policy terms applicable to and binding on each Insured are the terms of this Policy, read together as one contract. 2. Notice Every notice or communication to be given or made under this Policy shall be delivered in writing to the Insurer.
3. Material Changes Notice shall be give as soon as possible to the Insurer of every change materially varying any of the facts or circumstances existing at the commencement of this insurance. 4. Reasonable Care The Insured shall take all reasonable precautions for the safety of the Mobile Phone. 5. Termination of Individual Coverage Each insured’s coverage under this Policy: · Will terminate when he ceases to be a SingTel Mobile customer · may be terminated by the Insurer at any time by giving immediate notice in writing to the Insured and the policyholder. No premium paid shall be refundable if the Insured ceases to be a SingTel customer or if the coverage is terminated by the Insured. 6. Governing Law The governing law of this Policy is Singapore law.
